Notice of Amendments to the Terms of Use

We are writing to inform you of upcoming amendments to our Terms of Use to clarify the allocation of responsibilities and risks during shipping.

■ Main Amendments

These amendments change the timing at which "ownership" of products transfers during shipping, and clarify the "bearing of risk" (responsibility for loss or damage) during transit.

Article 4, Paragraph 5 — Change in Timing of Transfer of Ownership
The timing of the transfer of ownership of products (excluding digital content) will be changed from "at the time the products are delivered to the Registered User" to "at the time the Company delivers the products to the delivery company."
Article 4, Paragraph 6 — New Provision for Bearing of Risk
We have explicitly stated that the Company will, in principle, bear the risk for unforeseen accidents or losses during transit caused by events not attributable to either party. Please note, however, that the customer will bear the risk of non-delivery in cases attributable to the customer, such as long-term absence, refusal of delivery, or an incorrect address.
Article 12, Paragraph 5 — Adjustment of Disclaimer Provisions
In connection with the newly established risk-bearing clause, the wording regarding the scope of responsibility after shipping has been adjusted accordingly.

【Article 4. Purchase of Products - Paragraphs 5 and 6】

5. Ownership of the Products purchased by the Registered User through the Service shall be transferred to the Registered User at the time when the Products are delivered to the Registered User.

(Amended)
5. Ownership of the Products purchased by the Registered User through the Service (excluding digital content) shall be transferred to the Registered User at the time when the Company delivers the Products to the delivery company.
6. 【New】Notwithstanding the preceding paragraph, any risk of loss or damage of the Products that occurs prior to the Products being delivered to the Registered User due to reasons that are not attributable to either the Company or the Registered User shall be borne by the Company; provided, however, that this shall not apply to the risk of loss or damage in cases where the Products are not received due to reasons attributable to the Registered User set forth in each item of Article 5(2), including, but not limited to, the Registered User’s refusal to accept the Products, the Registered User’s long-term absence, an error in the Registered User’s address, or any other reasons attributable to the Registered User.

【Article 12. Disclaimer of Warranty and Exemption of Liability - Paragraph 5】

5. The Company’s obligations to the Registered User under the PSA shall be fulfilled by the Company shipping the Products to the shipping address entered by the Registered User upon purchasing the Products through the Service. The Company shall not be liable in any way for the failure of delivery of the Products unless the reasons are attributable to the Company.

5. The Company’s obligations to the Registered User under the PSA shall be fulfilled by the Company shipping the Products to the shipping address entered by the Registered User upon purchasing the Products through the Service. The allocation of responsibility and the bearing of risk with respect to the loss, damage, failure of delivery, or the like of the Products after shipping shall be in accordance with the provisions of Article 4(6).
